Understanding DMCA

Seriously speaking, the Digital Millennium Copyright Act (DMCA) is a federal law that protects copyrighted content creators. It provides a standardized process for copyright holders to request takedown of infringing materials.

Here’s the reality: We take intellectual property seriously at Tube Operator. If your copyrighted work is being used without permission on our platform, we have a clear process to help you. But we also respect creators who use content legitimately—that’s why we ask for thorough investigation before any takedown.

Important: Know Before You Submit

Did you know that submitting false DMCA claims is a federal crime? It carries real consequences, including:

  • Criminal liability – Intentionally lying in a DMCA notice violates U.S. Code Title 18, Section 1621
  • Civil liability – You could be sued for money damages
  • Content creator impact – Real people pour their hearts into their work on our platform

This is why we strongly recommend:

  • Investigate thoroughly – Make sure the use isn’t actually permitted under fair use or other exemptions
  • Consult with an attorney – Legal expertise matters for serious claims
  • Contact the user first – Try resolving it directly before escalating
  • Use trained professionals – Never use automated bots to submit notices in bulk

How to Submit a DMCA Takedown Notice

If you have a legitimate copyright infringement claim, send your notice to:

Include the following information:

  1. Your signature – Your full name (electronic signature is fine)
  2. The copyrighted work – A link to your original content or clear description of what’s allegedly being infringed
  3. The infringing material – Where it’s located on our platform and details we need to find it
  4. Your contact information – Physical address, phone number, and email
  5. Good faith statement – Confirm you believe this use is unauthorized
  6. Sworn statement – Under penalty of perjury, that the information is accurate and you’re authorized to act on behalf of the copyright owner

Pro tip: Plain-text emails get processed faster than PDFs or attachments. Keep it clear and direct.

Physical Mail Option

If you prefer to mail your notice (though email is much faster):

Tube Operator – Legal Department
No. 35 Le Van Luong Street, Thanh Xuan Ward, Hanoi, Vietnam 100000

What Happens Next

Here’s how we handle takedown notices:

  • We review the notice to confirm it meets DMCA requirements
  • If valid, we disable the infringing content within a reasonable timeframe
  • The affected user is notified and has the right to submit a counter notice
  • If a counter notice is filed, content remains disabled for 14 days unless you initiate legal action

Remember: We don’t make judgments about the merit of claims—that’s for the courts and the parties involved. Our job is to follow the legal process.

Counter Notices – For Content Creators

If your content was mistakenly disabled by a DMCA takedown, you have the right to fight back with a counter notice.

Before submitting, make sure you:

  • Understand that counter notices are also submitted under penalty of perjury
  • Have verified the takedown was incorrect or that your use is authorized
  • Can clearly explain why (fair use, license, authorization, etc.)

Submit your counter notice using the same contact information above.

Bottom Line

The DMCA exists to protect creators like you—and that includes creators using our platform. We handle every claim seriously, but we ask that you do the same.
